If you do not agree to any of the practices, terms, or conditions of Our Privacy Policy, you may not use the myBenefits App, Our Website, or any other element of Our Services.

Registration. Before using the App or other elements of the Service for the first time, you will be asked to register with Us and to provide Us certain personal information, such as your first and last name, email address, mailing address or other contact information and personal details. In addition, when you register, you will automatically be authorizing your employer to share with us additional personal information about you, including your employment status, job profile, compensation and related employment information, health benefits, and past or present health status and other health information. This information is required to identify you, to communicate with you regarding your use of the Service or the terms governing Our Services, and to provide Our Services, and to facilitate the functioning of Our Service or related services and/or technology. We may also use this information to notify you of new features on the Service, to inform you of other products and services that we believe may be of interest to you, or to request that you provide feedback Our Services. We may keep this information indefinitely.

Health and Medical Data. When you any of Our Services, any health or medical data that is input or otherwise posted to the Service, or that is provided to us by third parties such as your employer or your health care provider(s), including without limitation information regarding your past or present health conditions, health care services, medications, dosages, and contemplated medical or other procedures, will be obtained by Us. We will use this information to provide Our Services to you as it is intended to be provided, and to inform you of other products and services that we believe may be of interest to you. We may also use such information for targeted advertising and other marketing purposes. We may keep this information indefinitely.

Usage Data. When you use the Service, We will collect certain usage data generated through your use of Our Services. We may use this information as part of our providing Our Services to you, and to improve the experience of users with Our Services. We may also use that information for targeted advertising and other marketing purposes, or to request that you provide feedback about Our Services. We may keep this information indefinitely.

Location Information. When You use Our Services, we may collect information regarding your location from the GPS functionality in your Apple device with the myBenefits App. We may use this location information as part of Our providing Our Services to you, and to improve the experience of users with Our Services. We may also use such information for targeted advertising and other marketing purposes, or to request that you provide feedback about the Service. We may keep this information indefinitely. 

Online Inquiries.  When you submit an inquiry via the myBenefits App or Our Website, we ask for your first and last name, email address, mailing address and certain other information. We request this information for identification purposes, and to communicate with you regarding your inquiry. We may keep this information indefinitely.

Correspondence. If you correspond with Us through any of Our Services (or via email), we may gather in a file specific to you the information that you submit. We may keep this information indefinitely.

URL and IP addresses. Like many other providers of online services, We collect information about users of Our Services. This information helps us to design Our Services to better suit our users’ needs. For example, Our Website will track the URL that you visited before you came to our Website, the URL to which you next go and your Internet Protocol (IP) address. We may use your IP address to help diagnose problems with Our server and to administer Our Website and other elements of Our Services. Your IP address also is used to help identify you and to gather broad demographic information. We may keep this information indefinitely.

In addition, if you use the Service outside of the United States, information that we collect about you through the Service will be transferred to servers inside the United States and maintained indefinitely, which may involve the transfer of information out of countries located in the European Economic Area. By using the Service, you consent to such transfer and processing of data about you.

We will not share health or medical information about you with your employer in a form that we believe would allow your employer to identify you.  We also will not sell or otherwise disclose your health or medical information to third parties, except as described in Our Privacy Policy, without your permission.

What security measures do We employ for information about you collected through Our Services?

To help protect the privacy of data collected through Our Services, we use security measures for personal information that are intended to be consistent with standards of good practice in Our industry. In addition, we take commercially reasonable steps to store personal information with the objective of protecting such data against unauthorized access. However, PLEASE BE AWARE THAT Our Services ARE operated on software, hardware and networks, any component of which may, from time to time, experience breaches of security or other problems beyond our control.

Therefore, although We will take reasonable steps to protect the security and integrity of all information you provide through Our Services, due to the inherent nature of the Internet as an open global communications vehicle, We cannot guarantee that any such information, whether during transmission through the Internet or while stored on Our systems or otherwise in Our custody or control, will be absolutely safe from intrusion by others who do not have your authorization. Any such transmission or sharing of that information is done at your own risk.

How can you correct or update information about you that is stored by Us?

You may correct or update information collected about you through Our Services by contacting Us either through the myBenefits App or at the email or mailing addresses noted below. We will use commercially reasonable efforts to update our files as promptly as possible.

We may retain original and updated information for reasons such as technical constraints, dispute resolution, compliance with laws, fraud prevention, troubleshooting and agreement enforcement. In addition, We are not responsible for updating or removing any information about you collected through Our Services that is already disclosed to third parties who have been provided such information as permitted by this Privacy Policy.

At this time, We do not support “Do Not Track” preferences that may be available in your browser for letting websites know that you do not want them collecting certain kinds of information. Specifically, if you turn on the Do Not Track setting on your browser, Our Website and other online elements of Our Services are not currently capable of following whatever Do Not Track preferences you set. Our Privacy Policy only addresses the use and disclosure of information collected through the Service by Us. We are not responsible for the privacy practices of third parties or the content of linked websites. What is our policy on children using of Our Services?

While you may use Our Services for or on behalf of your children, We do not knowingly collect or maintain personally identifiable information from persons under 13 years old, and no part of the Service is directed to persons under 13. IF YOU ARE UNDER 13 YEARS OF AGE, YOU MAY NOT USE OR ACCESS ANY OF OUR SERVICES AT ANY TIME OR IN ANY MANNER. Will your employer have access to information that collected about you through the Service?

We will not disclose any health or medical information about you to your Employer that we believe may be used to identify you.  If your Employer informs us that you are no longer eligible to use Our Services by reason of your employment, then we may may terminate your right use to access Our Services, and then delete your personal information from our systems.

What are your California Privacy Rights?

From time to time, We may share information collected from you with third parties for their direct marketing purposes. Under California law, a California resident with whom we have an established relationship has the right to request certain information with respect to the types of personal information that We have shared with third parties for these purposes, and the identities of those third parties, within the immediately preceding calendar year, subject to certain exceptions. All requests for such information must be in writing and sent to Us as set forth below under the heading “How can you contact Us?”

What law governs my use of the Service?

By using Our Services, or otherwise providing information to Us, you agree that any dispute over privacy or the terms contained in this Privacy Policy will be governed by the law of the State of California, without reference to the choice of law or conflicts of law principles thereof, and will be subject to the dispute resolution clause contained in the terms of use applicable to the myBenefits App or Our Website, as applicable. You also agree to abide by any limitation on damages contained in the end user license agreement applicable to myBenefits App, the terms of use applicable to Our Website, or any other agreement that we have with you.

What are the terms regarding any future changes to this Privacy Policy?

We reserve the right to update or modify Our Privacy Policy from time to time, with any such changes to be effective prospectively. Please visit this page periodically so that you will be apprised of any such changes.
